5. “Electronic Manuals” means electronic manuals or any other related information, including errata of these manuals provided in This Service.

6. “Owner’s Manuals” means owner’s manuals and related documents of our products which are supplied with the products.

7. “Account” means an ID and a password which is issued to Commercial User to use additional functions of This Service.

8. Kawasaki Heavy Industries, Ltd. calls itself “we” in this Terms of Use.

User expressly acknowledges and agrees that:

 

1. This Service does not necessarily provide all manuals for all of our sold or future products,

2. Electronic Manuals are based on the information when the products are released, and they may not contain the latest information due to new or revised regulations, change in specifications or discontinuation of marketing,

3. This Service does not provide safety precautions for using products, but they are contained in Owner’s Manuals, and User is required to read Owner’s Manuals carefully and confirm instructions and precautions for use because they may vary by model year, and

4. If Private User finds any difference between Electronic Manuals, Owner’s Manuals and any other contents provided on this website, or loses Owner’s Manuals, please contact directly to the Kawasaki dealer.

This Service and any contents thereof (including the URL of this website) may be changed, suspended, discontinued or terminated at any time without prior notice to any User.

1. The intellectual property rights and all other rights used or embodied in connection with This Service and any data, figures and software used in This Service, including rights of Electronic Manuals, remain the property of us or a third party who grants us a license with respect thereto.

2. We do not grant User to reproduce, modify, publicly transmit, publish and distribute This Service, Electronic Materials and information therein, in whole or in part, without prior written consent of us.

Private User acknowledges and agrees that Private User will not conduct and will not cause any third party to conduct the following activities:

 

1. infringing, whether actually or potentially, on the intellectual property rights or any other rights of us or any third party,

2. scraping or otherwise using any data mining, robots or similar data gathering or extraction methods on or in connection with this website,

3. using This Service and Electronic Manuals for any purpose other than personal use or non-commercial internal use, and

4. violating any laws and regulations and public order.

Commercial User acknowledges and agrees that Commercial User will not conduct and will not cause any third party to conduct the following activities:

 

1. infringing, whether actually or potentially, on the intellectual property rights or any other rights of us or any third party,

2. scraping or otherwise using any data mining, robots or similar data gathering or extraction methods on or in connection with this website,

3. using This Service and Electronic Manuals for any purpose other than sales and service activity,

4. disclosing Account information or any other information in This Service or Electronic Manuals to any third party without prior written consent of us,

5. using Account at any place other than the place where Commercial User registers in, and

6. violating any laws and regulations and public order.

1. to the extent not prohibited by applicable law, we make no guarantee whatsoever regarding the certainty of provision of this service and the stable access to this website.

2. to the extent not prohibited by applicable law, we expressly disclaim any responsibility for any damage of user or any third party incurred directly or indirectly by following matters even if we know the possibility of such damage:

(1) any result that user uses or is unable to use of this service,

(2) any result of a judgement and/or an activity by user which is based on this service, any contents of this service and/or electronic manuals,

(3) any third party’s activities such as falsifying, deleting and unlawful accessing, disclosing or using of this service or any contents of this service and/or electronic manuals,

(6) any special causes whether or not we can foresee them, and
